Hi,
I had my stamping done in Delhi last year in September. They just asked me the following:
1. Latest Paystubs.
2. W2.
3. Client name.
4. My responsibilities at work.
5. How long have I worked at my employer.
All this took just a couple of mins. One of my friend also got his stamping done in Delhi in Dec last year.
Just carry all documents you can. They will not be needed, but you be more prepared and confident at the interview.

Hi, I am currently on my 5th year H-1B visa. I have an option to stay with the same firm and they will help me apply greencard. But I am also considering an opportunity in Bermuda for a 2-3 year program (with the same firm).
My question is if I come back to the US after 2 years, will I be able to apply H-1B visa again? Will it be a whole new H-1B petition/application process subject to the H-1B cap?
Or will it be just another H-1B renewal process following my previous two terms?
Do I need to wait for another two terms of H-1B to expire before starting the greencard process?
Can I ask my currently employer to apply for greencard concurrently while I am working outside the US?

I believe you can change your appointment 2 times ( or probably three times only ). You should be able to change your appointment to Delhi if dates becomes available and you are within the limit of number of changes of appointments allowed.

How difficult would it be to work with the USCIS dept to "allow" filing of I-485 stage on a continuous basis when priority dates are not current? In the current scenario they are pre-adjudicating cases up to July 2007 and are allocating visa's number to them as and when DOS makes them available. They can might as well allow a continuous filing of 1-485, pre-adjudicate them, and then we can wait when DOS gives the visa numbers to get the GC. On the USCIS side of things they will at least reduce their deficit, from fees for i-485, EAD, AP, Renewals. On our side we get the EAD which eliminates employer dependency, visa stamping, visa renewal, proving employer-employee headache. This may sound like a baby step to streamline the GC process. Will this need any type of legislative effort? Is this possible?

If no websites, find the address from the State Governor's website and send a letter explaning the situation. they will send you a document-release form. Fill that form and send copies of all the required documents for your case.

Hi,
I have a valid H4 stamping till Sept 2010. I got my H1B approved last year(2009) and COS from H4 to H1 approved. My H1B was effective October 1, 2009. Due to recession, I still have not been able to find a job. Now I want to change my status back to H4.
As I have a valid H4 stamping on my passport, can I travel across the border to Mexico, surrender my H1B I94 and reenter the US with a new H4 I94? Is that possible? Can that be done on the same day? Or should I apply for a COS - Form I539 and get it done here?
Please respond at the earliest.

Thanks for all the help and good counsel.
Lesson from this experience: Learn to handle delays. Take things in your stride. Do not make GC as end of your life. We can work anywhere and be happy, though US is a preferred destination.
In this process, I made so many friends and learned to heed others views and good advice.
Will continue to work for IV.

I want to find out if the remarks section of the I-693 form should be filled in by the civil surgeon for applicant who has LTBI and according to CDC is recommended to go for Evaluation for Treatment for TB.
From USCIS website:-
USCIS - Questions & Answers:<br>Changes to the Tuberculosis and Vaccination Requirements Required for Adjustment of Status (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=1758d5b07655b110VgnVCM1000004718190aRCR D&vgnextchannel=da3eaca797e63110VgnVCM1000004718190a RCRD)
Q: Both the CDC and USCIS have revised their requirements for medical referrals, as notated on Form I-693. In what instances must the referral section in Part 3 be completed?
Only complete Part 3, Referral to Health Department or Other Doctor / Facility, if the referral was required, such as when a Class A condition is suspected and needs further evaluation. Do not complete Part 3 if the referral was merely recommended by the CDC. Instead notate the (recommended but not required) referral in the Remarks box under that particular disease or disorder. This will help alleviate the possibility of USCIS rejecting the Form I-693 due to an erroneous assumption that a follow-up evaluation was needed before completion of the form

Hi all,
I have a simple problem but can't get an anwer at the consulate because the person who's name is on the website to call is unbelievably rude even when I was very polite in asking 2 questions and calling him 'sir' all the time :(
I got my renewed passport yesterday and it doesn't contain my husband's name in the spousal name areal. So the problem is this:
1. I have applied for an H4 visa and I sent a copy of that application along as they requested.
2. All my proofs of residence were based on my marriage as the utility bill is in his name so there could be no confusion about the fact that I am married and the name of my spouse.
3. My address in India has been stated as my husband's address already but his name is not on the passport - is this really a problem?
4. I don't want to face any trouble when traveling as I'll be on an H4 with a passport that doesn't have hubby's name on it.
My question is:
1. Do I need to send anything else to them other than my new passport, an attested copy of my marriage certificate, and a $20 check for the return express mail?
2. Does the Washington DC consulate have an email address where I can submit a query as the two people listed on the website to call for passport problems do not seem to want to talk to anyone?
3. Can I possibly call the Chicago or SFO consulates to ask my questions as they seem to be better people (my hubby and brother got theirs renewed in these places)?
Please help!

I am a labour substitution case pd feb 2002 filed 140 in June at NSC. My 140 has been pending for more than a year. Now recently I received 2 year ead.
Does this imply my 140 is approved too???
Is it safe to work on ead of one gets 2 year ead with pending 140.??

I do not understand why they grant EADs when your I-140 is not approved. The reason I bring this up is if a person loses his/her job and your I-140 is revoked, the EAD is useless. You cannot use AC21 for that because your I-140 is not approved.
Nebraska center is doing nothing regarding I-140 EB-3 (India) apps. The I-140 date at Nebraska has beeing moving by 1 day per month for the last 7-8 months. It is stuck at March 30th 2007. Moreover, the latest "as of" i.e. "report" date that you see on Nebraska is July 31st 2008. It is not current (Sept 2008) as many of you may think.
I understand that they receive 1000s of applications but that is no excuse for incompetence. As of July 31st, it was taking them 1 year and 4 months and now it is 1 year and 6 months to process I-140.
Why don't they re-institute expedited I-140 approval?
Can IV please help us?
