Hi everyone,
Here is my situation and I need URGENT help.
I am currently on L1-A for past 7 years (Visa expires Nov 07). During this span my company's attorney has unsuccessfully filed my I140 (twice was rejected at NSC and later TSC - due to 3 year degree and also my job description prior to transfer to US did not showed I have managerial/management function of a department). He refiled again this time with proper documentation and additional support letters from senior exec from my company.
I suspect he has been making mistakes in my filing and my time is running out. I am thinking of using my own money and hire another lawyer to file a fresh I140/485. Is this possible since I have already 2 pending I140; one at NSC under EB-1C and another at TSC under EB-3?
Please reply urgently if anyone has the answer to my question as I am running out of time.

My employer filled EB-2 PERM for me on 12/2007.
My I-140 is approved on 07/2008.
Now I am worry about losing my job.
If this happens, maybe I will switch to NIW pathway later.
Now I wonder whether NIW can use the PD of PERM?
My attorney is not sure about this.
Anyone here succeed in this?

Simple answer is "YES YOU CAN" :)
But start on your NIW case soon, it is much easier to get NIW done if you have a job while applying. Also there is no premium processing for NIW yet, so work on it now, dont wait till you get laid off.
Additionally, get a good attorney! NIW case requires a "VERY good attorney", not the one who is not sure of some simple thing like porting of PD.

I�m in EB2 and My I-140 was approved on March 2009 through Employer A. After which I moved to India and now am back (Nov 2010) with Employer B. My old Employer A has my apporved I-140.
It would be great if I get answer the below my Question:
1. Can I apply for I-485 with my new employer B based on my approved 140?? OR
2. Do I need to go back to my old employer A to apply my I-485. If yes is there any specific time period to go back to my old employer A.

1. Since you are asking the question for applying for I-485 with employer B, I presume that you have not filed for I-485 with employer A. If this is the case then you will have to apply for new labor. Once you have new labor approved, then you will have to apply for I-140. Now, if in case you had already filed for I-485 with employer A and the case has been pending for more than 180 days, then you can switch jobs using AC21.

Hi,
Need quick suggestion:
Company A filed for GC. Labor and I-140 was approved. I-485 was filed during July 2007.
I changed employer in June 2009; replied to RFE and filed AC21 in July 2009.
I came to know that my GC sponsring company is going to close the company soon. My current immigration attorney is suggesting that if that happens; and if INS came to know that GC sponsring company is closing down, they will revoke my I-140.
Is it true? I thought after AC21 is invoked; whatever happens to GC sponsring company, it will not impact my GC application in any way.
Please advice.

I don't know if here is right place to post this or not. I responded to RFE about 30 days ago and got an email update that TSC has got my response and the case processing is resumed. That was 485 and TB skin test that I had to do again.
Anyone has any idea what is normal time after response to RFE? I am EB3 with PD of Oct, 2003.
Do you recemmend me to call service center or go for infopass?

I would suggest that take an info pass and meet an immigration officer and explain the situation to him personally and if possible given him a written explanation too. What i find a little wired that when you applied for extension you did not notice that that I 94s got exhanchged and even if you did you went ahead and applied for extansion. In my opinion never apply for extension as the applicants next visit is in jeopordy irrespective of result of extnsion of i 94 .

With the opening of its first New Delhi outlet, ice cream brand Haagen Dazs adopted an interesting if not ridiculous policy: those with international passports were allowed in while Indians themselves weren't. Times of India's Rajesh Kalra provides a tale of a friend who was turned away by Haagen-Dazs enforcers. Here's a brief excerpt:
"I immediately called Ramit. 'You are an international traveler, and you have a passport, so you can go in', I said. Ramit's response was instant: I tried to enter but they said you are not allowed for you don't have an international passport. I am normally not given to immediate emotional reactions, but I couldn't resist this time. I was, to be honest, upset. How can they do this to an Indian, in India? Do a story on TOI or NBT? Do it for print or Online? Call other media friends and colleagues? I simply didn't know how to react. Print would have a better impact, but should I wait that long?"
Kalra didn't wait long. He contacted local authorities and used Facebook and Twitter to get the word out to the Indian community and as expected, HD's actions drew plenty of ire. According to BoingBoing, after a fitting public outcry thanks in part to Kalra's efforts, the operator of the franchise (who ironically is Indian) has axed the policy and apparently now claims it never existed.
Kalra, though, chalks this discrimination up to an age-old mentality of some Indian people. "I have often maintained that we ourselves are our biggest enemies. Our mentality is that of slaves and we think anything is good only if its approved by foreigners, or the 'holders of international passport[s].'"
You'd need to wait till you are a US citizen for that!!!

Apparently, no movement for EB3 ROW from November 2006 - April 2007:
November - 2006: 01AUG02
April - 2007: 01AUG02
In May 2007, it jumped to 01AUG03. I hope that there will be a movement in Jan 2009, Feb 2009 VB but looking at the trends it doesn't smee like there will be any.
I thought they changed their mindset from having no movement most of the year then jumping ahead several years in the last quarter and playing catch up.. this is what got them the 07 fiasco
but apparently they are repeating the trend

The 65,000 visas allotted for 2007 were taken by the end of May last year, months before the end of the fiscal year in September, said Jack Krumholtz, the head of Microsoft Corp.'s government affairs office. It is also difficult to get permanent U.S. residency for foreign workers who would like to stay, he said.
"This is becoming for high-tech companies a huge retention issue," Krumholtz said. "We will start to see highly valued tech employees emigrate back to their home countries."

I am currently working for big consulting firm, they hold my H1 and 485 is pending for more than 6 months. i have valid EAD from pending 485.
I am getting full time opportunity, my new employer is ready to transfer H1 as well as they are willing to accept me using EAD. so its entirely my preference.
can you please tell me adv/dis adv of using H1 over EAD or vice versa. (my 6 yrs of H1 will finish in another 6-7 months)

As you already know, the H4 is only valid as long as your H1 is valid. If companyA has a policy or if in future they decide to revoke h1, then you may not even know.
If I were you , I will go ahead and file for h4 transfer too.

Is there any risk in rescheduling a fingerprinting appt? I am travelling when the appointment is currently scheduled for:(. Does that impact the overall processing times of 485/EAD/AP?
With an travel plans that you can attach asking for a later date for the FP. If possible give them the possible dates you will be arriving back and request a date after that. Make sure in your absense somebody is available to pick up your FP notice from the mailbox. Send your request as early as possible with a delivery confirmation and/or signature requried so you have a track of whether your letter made it to them in time just in case..

Let the flowers reach them; let the suitors file the suit. But don't you think we should start a 'Seek information' campaign. Each of us write letters and faxes to DOS and USCIS and request them for this.
In May'07 the DOS moved forward the visa dates by 2 years for almost all categories. Now since USCIS have already receipted (or will soon do it) all the June applications, they should be in a position to release the information on how many applications they received for each category and for each country. We will request both the agencies to work together and release some kind of statistics some predictions like what they expect for Sept visa bulletin and further. We are living in dark and information like this will give us some insight and will let us plan our careers.
Guys please think about this seriously, I think this is the need of this hour.

I used the AR-11 form for the change of my address. I did it online. Also, while changing there is an option to change the address for any pending petition. In my case it is the I-485, which I changed.
My question is, how to verify if the address has actually changed in the system at USCIS. I checked my case status online and did not see any LUD's.
Please let me know if anyone of you have done the change of address and share your experience.

Call the 1-800 number and navigate to an rep via the POJ method.. You can verify you address with them.
